What the term means

Unlawful AI is not one product. In EU texts it usually points at prohibited AI practices: systems that may not be placed on the Union market, put into service, or used for listed purposes. The original list is Article 5 of the AI Act (social scoring, untargeted face scraping, certain biometric uses, and others).

From 2 December 2026, Regulation (EU) 2026/1744 adds two more bans that matter for NCII:

  • AI that generates or manipulates realistic images, video, or audio of an identifiable person’s intimate parts, or of that person in a sexually explicit act, without that person’s explicit consent
  • AI that generates or manipulates child sexual abuse material

Who the ban targets

Putting a system on the market is prohibited when that intimate generation is the intended purpose, or when it is a reasonably foreseeable, reproducible outcome and the provider has not built adequate safeguards. Using a system is prohibited when the deployer uses it for that purpose. The rule is aimed at tools and at people who use them to undress a real, identifiable adult without consent — not at every fictional drawing.

How it differs from other labels

  • Unlawful / prohibited is a legal status for a practice or a product in the EU. Authorities can stop it being sold or used as listed.
  • Undesired content detection is a classifier that scores “sexual / hate / violence.” It is a filter, not a court order. See Undesired content detection.
  • Hashing (PDQ, MD5) matches a known file. AntiNCII does that on your device. It does not enforce Article 5.

A lawful-looking general image model with weak safeguards can still fall under the “reasonably foreseeable” limb. A dedicated nudify site is the easy case. Grey tools, open models, and a PC at home are harder for any regulator to reach the same way. That gap does not make the harm smaller.

What a ban cannot do for you

  • It does not wipe copies already on Telegram, forums, or search results
  • It does not replace in-app reports or a case you open yourself
  • It is not worldwide criminal law; other countries use different statutes
  • AntiNCII is not the EU AI Office and cannot fine a vendor for you

What AntiNCII does instead

If you are an adult and someone made or shared an intimate image of you — including a synthetic one — you can create a case. The file stays on your device. We may share a fingerprint with participating platforms and send reports. Removal is never guaranteed. First-day steps: New victims: Please read first.
